Carroll city officials are reviewing city ordinances after the American Civil Liberties Union (ACLU) of Iowa sent a letter demanding they change the code concerning bans on drag performances. Current ordinances prohibit adult entertainment businesses, which include events, stores, theaters, arcades, and photo studios, from being located within 1,000 feet of another business, school, church, public park or playground, daycare center, school bus stop, or residential dwelling. The ACLU claims the city’s prohibition on “male or female impersonators,” which appears alongside bans on content generally considered to be indecent for the general public, is unconstitutional based on alleged First Amendment infringements. City Manager Aaron Kooiker says, “We have turned it over to our city attorney to review. After he has completed his review, we will comment.” Mt. Pleasant, Harlan, Webster City, and Polk City also received similar letters from ACLU-Iowa earlier this week. The ACLU has requested a response from the cities within 14 days regarding their intention to proceed with removing the language, which implies potential future legal action if the cities do not comply.
