Carroll County District Court Judge Denies Sex Offender’s Postconviction Relief Request

A sex offender’s request for post-conviction relief in Carroll County District Court has been denied. In May 2022, 79-year-old Raymond John Miller was sentenced to up to 25 years in prison for second-degree sexual abuse, a class B felony, for sexual contact with multiple juvenile victims between 2007 and 2015. Miller filed his application for post-conviction relief last December, claiming deception, ineffective assistance of counsel, and physical and mental disabilities. The court examined these claims during a hearing held at the Carroll County Courthouse earlier this week. The court found no evidence of deception by Miller’s attorney, as Miller had been informed of the potential penalties for his charges, including mandatory prison time. The judge ruled Miller’s claim of being denied his right to appeal due to ineffective assistance of counsel lacked any supporting evidence. Finally, the court determined that Miller’s guilty plea was knowingly and voluntarily given despite his allegations of physical and mental disabilities. As a result, the court denied and dismissed Miller’s application for post-conviction relief in its entirety. Miller will remain in custody at the Iowa Medical and Classification Center in Coralville. The earliest he could be paroled is July 19, 2043, at the age of 96.
