A Carroll man facing up to 10 years in prison on vehicular homicide charges will not be eligible to post bond if appealing his original sentencing. Carroll County Attorney, John Werden, on Wednesday filed a motion to correct the judgement on the sentencing of 18-year-old Kizer James Brockman that took place Monday morning. The motion states that, all defendants are bailable before and after a conviction, except in the case of an appeal to any class B or C felonies. Brockman’s conviction was on a class C felony, coming after he entered a guilty plea of homicide by vehicle, reckless driving, in the June 30, 2017 accident that killed 61-year-old Debra Renee Kock. In exchange for the plea, charges of homicide by vehicle, operating under the influence, and operating while intoxicated were dismissed. Brockman has 30 days to appeal his sentencing. All fines and surcharges have been suspended and Brockman will receive credit for time served, but he has been ordered to pay $150,000 in restitution to Kock’s family. An investigation into the accident by the Iowa State Patrol revealed that Brockman was under the influence of THC, the psychoactive ingredient in marijuana, and was traveling over 70 miles per hour when he went through a stop sign and struck the Kock vehicle.
