A Carroll farmer has filed an appeal in a case brought by the Carroll Airport Commission over a grain leg. On June 16, a judge ruled against the grain leg owners, Loren and Pan Danner, saying the structure affected public and pilot safety, and ordered them to abate the nuisance structure by reducing its height to be in compliance with county and city ordinances. The couple is now appealing that ruling. The Danner’s attorney, Steve Hamilton, filed a notice in Iowa District Court on Thursday, Sept. 14. The case was originally filed in 2015 and claimed the Danner’s 126-foot tower extended 61 feet into the Arthur N. Neu Municipal Airport’s protected airspace. Danner received a building permit from Carroll County in 2013 before constructing the grain leg.
