The Carroll Airport Commission has been dismissed from the proceedings for an appeal by a farmer over a Carroll County Board of Adjustments’ decision. In March, the Board of Adjustments denied a variance request from a grain leg owner, Loren Danner. The commission claims the structure extends 60 feet into the Carroll airport’s protected airspace and poses a danger to pilots. Danner did apply for and receive building permits from the county in 2013. The Airport Commission filed a motion to dismiss in April, and in a hearing on Tuesday, Danner’s attorney’s indicated they did not intend to challenge the commission’s proposal to be removed from the case. The appeal on the variance request is still ongoing with only the Carroll County Board of Adjustments named as a defendant. The Airport Commission has taken Danner to court in a related case demanding the grain leg be adjusted to no longer be in violation of county ordinances. Proceedings in the case of the Carroll Airport Commission V. Danner have concluded, but a ruling has not yet been made.
