City Of Carroll To Be Owners Of Property With Dangerous Building Designation

The City of Carroll will be the new owner of a property with a dangerous building designation. At Monday night’s council meeting, members unanimously agreed to pay $31,500 to Tom Daniel, owner of the City Apartments at 224 North Main. The purchase comes after the council upheld the designation on an appeal by Daniel in December. After that meeting, the two parties entered into discussions, arriving at an agreement for an initial payment of $500 to be escrowed until the July 31 closing, at which time the balance will be due. The city is allowing extra time for Daniel to remove items and fixtures from the building, as well as time to relocate as he is a resident at that address. During the approval process, however, City Manager, Mike Pogge-Weaver, asked the council to consider waiving an existing policy.

Council member, Misty Boes, asked Pogge-Weaver to outline details on the city’s sale to another party at a later date.

The property is zoned commercial, allowing for the building of a multi-family housing unit or a business. Councilman Clay Haley also asked for clarification on a section of the contract dealing with the remediation process if environmental hazards are found, and who would be responsible. City Attorney, Dave Bruner, replied.

Daniel will certify this in writing at the time of closing. Bruner adds that if there is something outside of Daniel’s knowledge, his responsibility may be somewhat reduced.
