The City of Carroll has filed counterclaims in response to a lawsuit against the city for allegedly failing to pay for work conducted on water supply well and transmission lines. In April, Drake Construction of Menlo submitted a petition to the District Court for Carroll County claiming work had been requested orally beyond the scope of the original contract and asked that damages be awarded to the company. According to court records, the city denies their claims and indicated they had made adjustments through the proper channels by using written change orders. On July 2, the city also filed a third-party petition against Northern American Specialty, the insurance company that provided the surety bond for the project. In that petition, the City of Carroll claims they suffered damages through delays to the project and additional labor and equipment costs and Drake Construction was the entity in violation of the contract. That lawsuit is scheduled to go to trial on Tuesday, Feb. 26, 2019 at the Carroll County Courthouse.
