A breach-of-contract lawsuit filed against the City of Carroll by a construction company is scheduled to go to trial next year. In April, Drake Construction, of Menlo, filed a petition claiming the city failed to pay for work completed on the community’s water supply well and transmission lines. Today (Tuesday), a District Court judge approved a trial date for Tuesday, Feb. 26, 2019 at the Carroll County Courthouse. The petition states Drake Construction suffered damages when the city refused to pay for work orally requested beyond the scope of the original contract. Either party retains the right to a settlement conference upon request up to the trial date.
