Attorneys Meet Next Week To Decide Trial Date For Carroll Library Lawsuit

A trial scheduling meeting for the library lawsuit filed against the City of Carroll, Carroll City Council and City Manager, Mike Pogge-Weaver is slated for next week. According to court records, the attorneys appearing in the case will convene through a conference call on Thursday, Sept. 26 to establish a firm trial date. Dr. Richard Collison, a vocal opponent of the library renovation, filed a lawsuit against the defendants, alleging they acted negligently and misled the public leading up to the August 2017 referendum that passed with nearly 62 percent of voters in favor of the city issuing $3.8 million in bonds to partially finance the estimated $6.85 million renovations to the library and city hall. On Monday, Sept. 17, a hearing was held in Boone County District Court on the defense’s motion to dismiss the case, and the judge has not yet issued a ruling on that motion. The courts are considering the case on an expedited basis, as the city was originally scheduled to award a contract for the project on Friday, Sept. 28.
