Motion To Dismiss Danner’s Appeal Of Board Of Adjustment Decision Set Later This Month

A date for a hearing to determine the future of a legal challenge between a grain leg owner and the Carroll County Board of Adjustments’ has been set. In March, Loren Danner requested a variance for a grain leg which the Carroll Airport Commission claims extends 61 feet into protected airspace. That request was denied, and Danner decided to appeal that decision in Carroll County District Court. Danner had filed for building permits from the county before building the structure. Documents were filed requesting a dismissal of the appeal by the Board of Adjustments and Carroll Airport Commission, and a hearing on the issue has been set for Tuesday, May 30 at 9:30 a.m.
