Cherokee County Woman Seeking Change Of Venue To Sac Or Buena Vista Counties In Attempted Murder Case

It is likely that jurors from either Buena Vista or Sac Counties will be hearing the case of Melissa Ebert, a 30-year-old Cherokee County woman who is accused of intentionally crashing her vehicle in an attempt to kill herself and her passenger. Her attorney, Montgomery Brown, has filed for a change of venue in the case, saying there has been “prejudicial and inflammatory” material published in the northwest Iowa press, making it nearly impossible to find an impartial jury in Plymouth County. On Sept. 9, 2015, Ebert was driving on County Road C-28 in Plymouth County, and allegedly intentionally swerved her SUV into the path of an oncoming car during an argument with the passenger, Damian Johnson. She struck the vehicle, driven by Dustin Boll of Le Mars, and all three were treated for serious, life-threatening injuries in the incident. Ebert was charged and booked into jail on a $50,000 bond, but later released.
