Telemarketer Must Reimburse Iowans For Buying Club Deception

Iowa Attorney General, Tom Miller, announced yesterday (Thursday) that a Connecticut-based marketing company will be paying $300,000 to the state of Iowa as just one part of a consent judgment filed Thursday in Polk County District Court. According to the judgment, Trilegiant employees worked to enroll an Iowa resident in the company’s “Great Fun” buying club by offering a flight booking discount in exchange for a free trial membership. Legal disclosures, however, were not divulged and the caller was unaware that the consumer is an investigator with the Consumer Protection Division. Miller said the moment the investigator provided his Iowa address, the telemarketer should have stopped the sales pitch as it was missing the required disclosures. A follow-up investigation revealed that all four telemarketing companies Trilegiant had contracted repeatedly engaged in the same subterfuge and deception, fraudulently enrolling hundreds of Iowans. In addition to the $300,000 paid to the state, Trilegiant has been ordered to issue refunds to Iowa consumers and cease telemarketing activities in the state.
