Kramer’s Motion To Set Aside Verdict And For A New Trial Overruled

On Oct. 13, 31-year-old Jeromie Alan Kramer of Westside was found guilty in Carroll County District Court of sexual assault in the third degree and lascivious acts with a child, both class C felonies. The charges stemmed from an incident in December of 2014, where it was reported Kramer had inappropriate contact with an 11-year-old female. Kramer had waived the right to a trial by jury, but earlier this week, he appeared in front of District Court Judge Gary McMinimee with a motion to set aside the guilty verdict and hold a new trial based on a letter that had been presented to the court by the victim in this case. In her letter, the victim said she believes Kramer has learned from his wrongdoings and she is able to forgive him. She also said she wished the incident had never happened and that she never wanted to press charges or have the incident reported in the first place. After reviewing the letter, Judge McMinimee stated that the defendant has failed to state grounds for a new trial or arrest of judgement. “Whether a victim wishes to press charges or have a criminal act reported is not relevant,” McMinimmee said in his order. “It is for the prosecutor, in the exercise of his/her discretion, to determine whether charges are brought.” The motion to set aside the verdict and the motion for a new trial, including a new hearing, were overruled. Sentencing in this case is scheduled to take place in the Carroll County District Courtroom at 10:30 a.m. on  Nov. 28.
