Dispute Over Arcadia Disposal Site Leads To Litigation For City Officials

City officials in Arcadia are advising residents to temporarily cease depositing yard waste on the south half of the community disposal site due to an ongoing legal dispute with the owner of part of the property. According to Carroll County District Court records, the issue began in March when Steven Hoogestrat, the manager of the property as trustee of the Lorraine Hunter Revocable Trust, pushed a compost pile off the south side of the lot in a manner that prevented vehicles to maneuver within the city-owned portion of the site, resulting in more than $1,000 in additional expenses to the city. In a small claims filing, the city says they entered into a 99-year lease with the owners of the property nearly 80 years ago, Frank and Mary Enenbach, to use the property, and Hoogestrat and the trust are responsible for the damages though violation of the lease. Earlier this year, Hoogestrat filed a countersuit against the City of Arcadia and Mayor, Kevin Liechti, as defendants. In the suit, Hoogestrat claims damage to the property and requests an environmental assessment be conducted at the site. The ongoing litigation will likely be transferred from the small claims court to Carroll County District Court to be resolved through a trial by jury. The northern half of the waste disposal site remains open and is available for use by Arcadia residents.
